Eligibility (17+)

These Terms are a legally binding agreement between you and Thrillium Team (“Thrillium,” “we,” “us,” or “our”). They govern your use of the Thrillium mobile application (the “App”) and related services (collectively, the “Services”).

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services are intended for users age 17 and older. By using the Services, you represent that you are at least 17 years old.

1) The Services

Thrillium makes caring for your flowers simple and smart. Snap a photo of any plant, and the App can identify it and deliver a tailored care plan — covering light, water, temperature, and more.

Choose from analysis modes including Care Plan, Plant ID, Watering Schedule, Disease Check, and Sunlight Analysis. Track progress with a built-in 7-day care cycle tracker, check in daily to build your streak, browse curated inspiration, explore seasonal care challenges, and revisit past analyses in a history view.

2) Accounts

  • You may need an account to use certain features.
  • You are responsible for maintaining the confidentiality of your credentials.
  • You agree to provide accurate information (name/username/email) and keep it up to date.
  • You are responsible for activity that occurs under your account.

3) User Content and Inputs

“User Content” includes information you submit or upload, such as photos, text prompts, messages to support, and profile information.

You retain ownership of your User Content. You grant Thrillium a limited, non-exclusive, worldwide license to host, process, and transmit your User Content solely to provide and operate the Services, including generating analysis results you request.

4) AI Features and Outputs

The Services may use automated and AI-based methods to generate results based on your inputs (such as plant identification or care recommendations).

Informational only: outputs may be inaccurate or incomplete.

Your responsibility: you are responsible for verifying suitability for your plant and conditions.

Not professional advice: do not rely on the Services for emergency, medical, safety-critical, or professional advice.

5) Acceptable Use

  • Do not use the Services unlawfully or abusively.
  • Do not interfere with or disrupt the Services, or attempt to reverse engineer them (except where prohibited by law).
  • Do not upload content that infringes rights or violates privacy.
  • Do not misrepresent your identity or attempt unauthorized access.

6) Privacy

Our Privacy Policy describes how we collect and use information. By using the Services, you agree that we may process information as described in the Privacy Policy.

7) Subscriptions, Payments, and Trials (If Offered)

If the App offers paid features, subscriptions, or trials, pricing and renewal terms will be shown at purchase. Subscriptions may auto-renew unless canceled according to your platform’s rules. Payments and cancellations are handled through the App Store (if applicable). If no paid features are offered, this section does not apply.

8) Intellectual Property

The Services and all associated content (software, design, text, graphics, and trademarks) are owned by Thrillium or its licensors and are protected by law. Except as expressly permitted, you may not copy, modify, distribute, sell, or lease any part of the Services.

9) Apple App Store Additional Terms (iOS)

If you downloaded the App from Apple’s App Store, the following also apply:

  • Acknowledgement: these Terms are between you and Thrillium, not Apple. Apple is not responsible for the App or its content.
  • Scope of license: your license is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the App Store’s rules.
  • Maintenance and support: Thrillium is responsible for maintenance and support of the App (if any). Apple has no obligation to provide maintenance or support.
  • Warranty: to the maximum extent permitted by law, Apple has no warranty obligation with respect to the App.
  • Product claims: Thrillium, not Apple, is responsible for addressing claims relating to the App, including product liability, regulatory compliance, and consumer protection claims.
  • Intellectual property claims: Thrillium, not Apple, is responsible for handling any intellectual property infringement claim relating to the App.
  • Legal compliance: you represent that you are not located in a country subject to a U.S. Government embargo, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

9) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” To the maximum extent permitted by law, Thrillium disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10) Limitation of Liability

To the maximum extent permitted by law, Thrillium will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Services.

To the maximum extent permitted by law, Thrillium’s total liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid to Thrillium for the Services in the 12 months before the event giving rise to the claim, or (b) USD $50.

11) Indemnification

You agree to indemnify and hold harmless Thrillium from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Services or your violation of these Terms.

12) Termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms or if necessary to protect the Services, users, or comply with law.

13) Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we will update the Effective Date. Continued use after changes become effective means you accept the updated Terms.

14) Governing Law

These Terms are governed by the laws of the jurisdiction of Thrillium’s principal place of business, without regard to conflict of laws principles, except where prohibited by applicable consumer protection laws.

15) Dispute Resolution; Binding Arbitration

Please contact us first at lancetilly63@outlook.com so we can try to resolve disputes informally.

If a dispute cannot be resolved informally, you and Thrillium agree to resolve any claim arising out of or relating to these Terms or the Services through final and binding arbitration, except that (a) either party may bring a claim in small claims court if it qualifies, and (b) either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property or security rights. If applicable law does not allow mandatory arbitration for a particular claim, that claim will be resolved in court instead.

You and Thrillium agree that arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action, to the maximum extent permitted by law.
